In the Brazilian context, the Brazilian Law on the Inclusion of Persons with Disabilities (Law No. 13,146/2015) establishes specific criteria to identify who is considered PWD.

This definition covers people with physical, hearing, visual and mental disabilities, as well as those with multiple disabilities.

What does the law say about hiring PWDs?

According to the Quota Law 8213/91, which despite being created in 1991 was only regulated in 2000, companies need to have between 2% and 5% of their vacancies allocated to rehabilitated beneficiaries and qualified people with disabilities.

This percentage of those hired in the quotas is made according to the number of employees in a company, and if the requirements and obligations are not met, daily fines ranging from R$2,143.04 to R$3,214.55 will be imposed.

And among the rules for hiring this type of professional, the first of them is that the company will need to publish a notice of the vacancy on the Ministry of Labor and Employment website at least 15 days in advance.

When hiring, the candidate will need to present a report proving their disability, generally this can be provided by the INSS, National Social Security Institute, or the Ministry of Education.

In addition, companies are also encouraged to promote accessibility and inclusion in the workplace.

The rules include adapting the work environment so that everyone can work comfortably, especially PWD employees, allowing them to have the same chances and opportunities within the corporate environment.
