And in August 2022, Bolsonaro sanctioned a project that set the minimum salary for midwives, technicians, assistants and, of course, nurses.

But in September an injunction was issued that suspended the category's minimum wage, the STF stated that the objective was to find solutions to enable payments to be made in both the public and private sectors.

As a result, in May this year, President Lula sanctioned a law that allocates R$7.3 billion to states and municipalities so that payments can be made from May onwards.

After all, what is the floor?

The minimum nursing salary values were established by Law 14,434/2022, which was a proposal made by Senator Fabiano Contarato.

For nursing professionals, a salary floor of R$4,750 was defined. For nursing technicians, the value was R$3,325 reais.

While the minimum salary for nursing assistants and midwives is R$2,370.00 reais.

When will the minimum nursing salary come into force?

According to the STF measure in 2022, the minimum salary has not yet started to be paid because an injunction was created to suspend this action.

However, in May 2023, Minister Barroso partially reviewed the injunction that suspended the Law.

This is already in force, but the other ministers need to speak out on the matter in the STF's Virtual Plenary. But this trial is suspended and is expected to resume within 90 days.

So, if the STF does not respond, the salary floor for private companies should start from July 1st.

Understand the reason for the controversy

In addition to nurses and healthcare professionals having spent a long time without a minimum salary, the main reason for the controversy and the suspension of the law in 2022 is that public and private establishments do not have budgets prepared for this.

This means that hospitals, clinics and other institutions do not have the money to pay all their nurses and professionals who have earned a minimum wage.

The law sanctioned by Lula is an aid to public entities, but even so they point out that it is not enough. While private companies are afraid of having to lay off part of their staff.
