What is the CLT?

The CLT, or Consolidation of Labor Laws, is a set of laws that regulate and promote the rights of workers, so that if the laws are not complied with, justice can be served.

It was created by Decree Law No. 5452 in May 1943, and was sanctioned by the current president of the time, Getúlio Vargas.

This set of laws has eight chapters that mainly cover labor rights and the companies' duties towards the contractor.

But what does the CLT say about life insurance?

Now the answer we wanted to know: according to the CLT, life insurance is not mandatory for employees, but not all companies are exempt from this need.

In addition, if your company offers this benefit, it is necessary to follow some rules.

First, let's learn about the rules for companies that offer life insurance to employees.

The first and main rule about life insurance, when offered, is that its value cannot be less than the employee's salary.

Another important point is that this insurance must cover both natural and accidental death.

But beyond that, the company can choose the insurance company it prefers and fits within the resources it has available.

And when is it mandatory?

Due to a series of conventions and collective agreements, it was declared that the activities of some functions make the need for life insurance mandatory.

These are the categories:

  • Gas stations;
  • Motorcycle couriers;
  • Real estate;
  • Textile industries;
  • Bakery and confectionery industries;
  • Service providers;
  • Bakeries;
  • Educational;
  • Dispatchers;
  • Crockery, earthenware and ceramics industries;
  • Retail food trade;
  • Restaurants and bars;
  • Condominiums;
  • Hospitality;
  • Construction.

It is important to highlight that, if the company offers life insurance as a benefit to employees, it must bear all insurance costs, without any deduction from the employee's salary.

Life insurance for interns?

The CLT does not regulate internships because the professional who works as an intern does not have a formal contract, that is, he does not qualify.

But for that there is Internship Law, Law No. 11,788/08 which regulates the function with all the company's obligations, and the rights of the intern.

And according to the Internship Law article 9, the company is obliged to take out personal accident insurance, not life insurance.
